The Supreme Court voted against President Donald Trump’s executive order to end birthright citizenship, which was a win for the U.S Constitution that the nation’s law built on it. “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” (Fourteen Amendment)
President Trump’s attempt to end birthright citizenship is part of his immigration policy, which is cracking down on undocumented immigrants. However, the policy of mass deportation that was implemented under President Trump turned into a mass chaos. Apparently, such chaos of deportation became an opportunity for the Democrats to intensify their attacks against Trump.
Although President Trump would be less likely to listen to the advisers and conduct his policy peacefully, the Republicans did not have a strategic plan to conduct such a mass deportation plan in a more civilized way. Labeling the undocumented immigrants as criminals in general by President Trump has agitated the public as in spite of their illegality in the U.S, the majority of undocumented immigrants are not criminals.
The Supreme Court’s vote blocked the political agenda of President Trump as he attempted to override the Fourteenth Amendment. Ironically, the President in the past has criticized the Democrats for undermining the Constitution while ending birthright citizenship with an executive order is an obvious subversion of Fourteen Amendment.
The American political system is under the pressure of the political conflict, and such conflict blocks the path to compromise and bring a solution to the ground. Undermining the U.S Constitution is only serving the political agenda and the interest of the politicians.
President Trump’s clear intention is to undermine the U.S Constitution as he wrote on Truth Social regarding ending birthright citizenship, “No long and unwieldy Constitutional Amendment is necessary!” Further, the President continued and wrote, “Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!”
The Fourteenth Amendment cannot be undermined with birthright citizenship being standing on the foundation of the Constitution, which is the highest law of the nation, and no president can violate it. However, the majority of Republicans support ending birthright citizenship while the majority Democrats oppose it.
Also, the majority of the American people 55% oppose ending birthright citizenship according to a Reuters/Ipsos poll survey. However, while the Fourteenth Amendment guarantees birthright citizenship for people born in the U.S, such a right should also be protected from abuse as the House Speaker Mike Johnson said that it has been abused.
But neither President Trump nor the Republicans have the right to repeal the Fourteenth Amendment unless a new proposed amendment was passed by the majority votes of two-thirds of the House of Representative and the Senate and ratified by three-fourths of the states. (FindLaw).
But after all, the Fourteenth Amendment should not be repealed , it is important to continue as a shield for those who were born in America.
